These Terms and Conditions ("Terms") govern your use of our website and services. By creating a profile, uploading photos, and/or using our services, you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Front Photography Ltd ("the Website"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use our services.
2. Description of Services
Front Photography Ltd provides a platform for users to create profiles, upload photos, and sell their photos as prints. We handle payments, printing, and shipping on behalf of the users. We charge a 15% commission on each sale and an additional £5 administration fee per transaction.
3. User Accounts
To use our services, you must create a user profile. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.
In order to receive payments, you must create a Stripe account. This is only required after your first image is sold.
4. Uploading and Selling Photos
Users retain full ownership of any images they upload to the Website. Front Photography Ltd does not claim ownership of your content.
By uploading photos, you grant Front Photography Ltd the right to use, display, and distribute your content for the purposes of providing our services (including marketing your photos on the platform, social media, and similar).
Uploaded photos may be reviewed by Front Photography Ltd to ensure they meet our content guidelines. We reserve the right to remove any content we deem unsuitable or in violation of our policies.
You are responsible for ensuring that your content does not infringe on the rights of any third party, including copyright, trademark, or privacy rights.
5. Payment and Fees
Front Photography Ltd will handle all transactions, including payments from customers, printing, and shipping.
A 15% commission will be deducted from each sale, along with a £5 administration fee. The remaining balance will be transferred to the user’s Stripe account.
Payments will be processed through Stripe, and users are responsible for ensuring their Stripe account information is accurate and up to date.
6. Content Review and Moderation
Front Photography Ltd reviews content uploaded by users but is not responsible for any material posted on the Website.
We reserve the right to remove any content that violates our content guidelines or Terms, without prior notice.
7. User Responsibilities
You agree not to upload any content that is illegal, offensive, defamatory, or infringes upon the rights of others.
You are solely responsible for the content you upload, including ensuring that you have all necessary rights and permissions to sell your photos as prints.
You agree to indemnify and hold harmless Front Photography Ltd from any claims, damages, or losses arising from your content.
8. Intellectual Property
Users retain full ownership of the images they upload to the Website. Front Photography Ltd does not claim ownership of any images.
You grant Front Photography Ltd a limited, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purposes of providing and promoting our services.
9. Termination
Front Photography Ltd reserves the right to suspend or terminate your account if you violate these Terms or engage in activities that are harmful to the Website or other users.
You may also terminate your account at any time. Upon termination, any pending payments will be processed, and your content will be removed from the Website.
10. Limitation of Liability
Front Photography Ltd provides the platform "as-is" and does not make any guarantees about the availability, quality, or accuracy of the services.
We will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including loss of revenue or data, except where such exclusion is not permitted under UK law.
11. Changes to Terms
Front Photography Ltd reserves the right to modify these Terms at any time. Changes will be posted on the Website, and it is your responsibility to review them periodically. Your continued use of the Website after any changes are posted constitutes your acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms will be resolved in the courts of England and Wales.
13. Print Orders, Returns, and Refunds
All purchases made through Front Photography Ltd are final. Since prints are made to order, we do not accept returns or exchanges once an order has been placed.
If a print arrives damaged or is not up to standard, the recipient must contact Front Photography Ltd within 14 days of receiving the print. Please provide details and photographs of the issue. We will investigate the matter and, if appropriate, arrange for a replacement print at no additional cost.
Front Photography Ltd reserves the right to determine whether a print is eligible for replacement based on the evidence provided.
